The institution defines and publishes policies regarding appointment and employment of faculty and staff.

Narrative/Justification for Judgment of Compliance:

Southwest Tennessee Community College provides equal opportunity in employment to all current and prospective employees. The College’s hiring procedures comply with Titles VI and VII of the Civil Rights Act of 1964, as amended, Title IX of the Education Amendments of 1972, the Americans with Disabilities Act, as amended, the Equal Pay Act of 1975, the Pregnancy Discrimination Act, all applicable state statutes, and Tennessee Board of Regents (TBR) policies and guidelines.

Standardized, published procedures outline the process for filling all permanent vacant positions. The "Employee Recruitment and Employment Package" [1] contains instructions and all required forms for the College’s hiring process. This packet is available in the Human Resources Department. The College’s hiring procedures are further documented in Southwest Tennessee Community College Policy 5:01:00:00/20 – Hiring Procedures [2], which complies with the provisions of TBR Policy 5:01:00:00 – General Personnel [3].

A "Request to Advertise" form and a "Preliminary Position Announcement" outline the type of position, position summary, essential job functions and required qualifications [1]. These forms are initiated by the requesting department administrator. Upon appropriate approvals of the request, positions may be advertised internally and/or externally. Position announcements may be posted on the College’s website, external websites, national, local, and regional publications as appropriate for the position.

Applications are received through the closing date of the announcement which is a minimum of ten working days from the date the position is advertised for clerical/support positions, and thirty days for faculty, administrative and professional positions. All applications are screened by Human Resources staff to establish a pool of qualified candidates who meet the minimum job requirements, with the exception of instructional positions which are certified by the department chairperson. The applicant pool is further reviewed and approved by the Director of Affirmative Action.

A Selection Committee is formed by the hiring department administrator for the review of candidates for all faculty, administrative, and professional positions. The Chairperson of the Committee convenes the other members to review the applications and determine which applicants are to be considered for an interview. The application and list of candidates recommended for interview are forwarded to the Director of Human Resources and the Director of Affirmative Action for review and approval on the "Interview Request" form. The Committee then interviews the prospective candidates, performs reference checks, and makes a final recommendation to the department administrator.

The "Faculty Credentials" form must be completed and approved prior to the initial appointment of all temporary, term and tenure-track faculty appointments [1]. This form delineates the required educational, licensure and/or certification requirements for the academic discipline. Full-time faculty on tenure-track contracts must be informed of academic requirements for tenure upon initial employment. Faculty appointments may be made at the appropriate faculty rank for which the candidate is qualified.

Emergency appointments, as defined by the President, may be filled by direct hire or through the establishment of a pool of qualified applicants from applications on file or through other appropriate means. Emergency appointments may not exceed one year, at which time the position must be advertised and filled competitively. An employee serving in this capacity is not eligible for internal promotion, transfer, or for consideration as an internal applicant unless it is determined by the Director of Affirmative Action that the original hire was accomplished through a competitive process.

Only the President of the College, or his/her designee, has the authority to offer and approve employment of personnel. The successful candidate is notified of the offer by the Director of Human Resources after approval of the "Recommendation to Hire" form [1].

Human Resources staff notifies the unsuccessful candidates in writing. In the event an offer is not accepted, the department administrator, in consultation with the Selection Committee if applicable, may either select another candidate or start the selection process over. Newly hired employees receive the appropriate employment contract, as outlined in TBR Guideline P-010 – Personnel Transactions and Recommended Forms [4], setting forth the conditions of employment. All contracts for employment must be signed by the employee and by the President.
